B. C, September 26, 2019, notified the Defendant of the assignment of claims by public notice of the declaration of intention No. 2019Kama452 on September 26, 2019.

Therefore, the defendant shall pay to the plaintiff 307,380,500 won with 5% per annum as stipulated in the Civil Act from February 15, 2020 to May 8, 2020, which is the day following the delivery of a copy of the complaint of this case, and damages for delay calculated with 12% per annum as stipulated in the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the next day to the day of complete payment.

(A) The Plaintiff filed a claim for damages for delay from May 16, 2012, which is the day following the settlement date, but the evidence submitted by the Plaintiff alone alone is unclear, so it is insufficient to recognize that damages for delay will accrue from the settlement date since it is difficult to deem that the Defendant delayed performance before the delivery date of the copy of the complaint in this case. Therefore, the Plaintiff’s claim for this portion is rejected).
