A. Defendant SP Construction Co., Ltd. is the Defendant’s list of shareholders listed in Section 1 of [Attachment I].

A. The party status 1) Defendant AS Construction Co., Ltd. (hereinafter “Defendant AS Construction”)

The purpose of the business is to carry out civil engineering, construction, electricity, information and communications, steel materials installation, packing, harbor construction, dredging, cable railways installation, landscaping, industrial equipment construction and operation, etc. The total number of the shares issued by Defendant Samsung C&T Co., Ltd. (hereinafter “Defendant Samsung C&T”) is a stock-listed corporation. The total number of the shares issued by Defendant Samsung C&T construction is 51,00,000 shares. 2) The Defendant Samsung C&T Co., Ltd. (hereinafter “Defendant Samsung C&T”) is a corporation established for the purpose of designing, constructing and dredging, electricity heating and cooling construction, harbor construction and dredging, reclamation, landscaping, electricity and telecommunications construction business, etc.

The total number of shares issued by Defendant Samsung C&T is 160,866,417 shares.

3) The Plaintiff is an organization holding 10 shares issued by Defendant AS Construction and nine shares issued by Defendant Samsung C&T. (B) The Defendants were ordered to pay penalty surcharges by the Fair Trade Commission on the ground that the Defendants committed an unfair collaborative act under Article 19(1) of the Monopoly Regulation and Fair Trade Act (amended by Act No. 11406, Mar. 21, 2012; hereinafter “Fair Trade Act”) with other constructors in the course of bidding as set out in the following [Attachment 1].

The amount of penalty surcharge on the date of the order to name the construction work (Curn-Ky) on August 31, 2012, Defendant Samsung Construction Co., Ltd., the first 14th River Curn-Ky project (Turn-Ky) project, which was filed on August 31, 2012, the first multi-purpose dam construction project, 19,823,000,000,384,000,000 permanent multi-purpose dams construction works, March 18, 2013 - around 7,045,000,000,039,000,000,005,000,000,000 or around February 2, 2014, the Defendants filed a lawsuit seeking revocation of the said disposition [the aforementioned disposition of imposition of penalty surcharge] around April 7, 2014,000,0000,000 [20,000]
