A. The sentence imposed by the lower court is too unreasonable.

B. It is unreasonable that the sentence of the court below rendered by the prosecutor is too uneasible.

2. As to the grounds for appeal by the Defendant and the prosecutor, the crime of murdering the victim living together by knife is not good, the result of the crime is significant, and the bereaved family members of the victim strongly demand the Defendant to punish the victim. However, in light of all of the sentencing conditions of the instant case, such as the Defendant’s age, character and behavior, environment, circumstances and consequence of the crime, etc., the punishment imposed by the lower court is too heavy or unreasonable.

3. The appeal filed by the defendant and the prosecutor in conclusion is dismissed in accordance with Article 364(4) of the Criminal Procedure Act.
