1. The instant lawsuit was concluded on March 17, 2015 as deemed withdrawal of the lawsuit.
2. The costs of the lawsuit after the request for setting the date.
A lawsuit of demurrer against a distribution schedule shall be deemed to have been withdrawn when the person who had raised an objection to the distribution did not appear on the first date for pleading of the lawsuit of demurrer against distribution (Article 158 of the Civil Execution Act). The fact that the Plaintiff was notified of the date for pleading on February 24, 2015, the first date for pleading on March 17, 2015, when the Plaintiff filed a lawsuit of demurrer against the distribution, was obvious in this court. As such, the instant lawsuit was terminated as deemed to have been withdrawn on March 17, 2015.
Therefore, it is decided as per Disposition by the Plaintiff’s declaration of termination of the lawsuit regarding the Plaintiff’s application for designation of the date of this case.
