1. The part of the lawsuit in this case is dismissed.
2. The defendant shall pay 122,868,900 won to the plaintiff and this shall apply.
1. The description of the grounds for the claim shall be as specified in the attached Form;
2. Articles 208(3)1 and 257(1) of the Civil Procedure Act, which hold a judgment without holding any pleadings.
3. We examine ex officio the dismissed part of the lawsuit in this case as to the legitimacy of the part claiming litigation costs.
The plaintiff is seeking the payment of the costs of lawsuit against the defendant, but there is no benefit to seek a separate reimbursement because the amount paid as the costs of lawsuit can be reimbursed through the procedure of confirmation of the costs of lawsuit.
(See Supreme Court Decision 9Da68577 delivered on May 12, 2000). Therefore, the part of the lawsuit in this case is unlawful as there is no benefit of lawsuit.
