A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
On July 5, 2002, when the defendant was accused of fraud, etc. and was investigated, the defendant applied for the issuance of a passport under the name of B (the death of March 4, 2002) on or around the beginning of December 2002, and received the issuance of a passport to B, on or around December 6, 2002, on which the defendant's photograph was attached, and thereafter, on July 5, 2003, the defendant left Korea using the above passport and was found to have been illegally staying in the Chinese airspace, and entered Korea around March 17, 202, with a view to escape criminal punishment.
1. On December 1, 2009, the Defendant forged official document: (a) the period of validity indicated on the passport issued to B ( December 6, 2007) was two or less in the name of the first police officer of China; (b) the period of validity indicated on the passport issued to B (the date of December 6, 2007) was expired; and (c) the Defendant was issued the Defendant’s name under the name of the Defendant’s name with the 10,000 draft (Korean approximately KRW 1.8 million) in the Chinese registry "KR", the passport number C, the name “D”, the name “B”; (c) the date of birth; (d) resident registration number “E”, “F”, gender M”, “06 DEC 209; and (d) the issuance date; and (d) the Defendant’s name with the Korean passport attached “Korean passport”.
Accordingly, the Defendant forged a passport of the Republic of Korea with respect to B in the name of the Minister of Foreign Affairs, a public document, for the purpose of uttering in collusion with a person who was not the victim.
2. Exercising forged official documents;
A. On March 3, 2019, the Defendant: (a) presented a forged passport with the Defendant’s photograph attached and recorded the personal information of B, as if it were a genuine passport, to which the Defendant was possessed by the above police station that verified the Defendant’s identity in the process of issuing the new passport, at around March 3, 2019.
B. On March 12 to 13, 2020, the Defendant confirms the Defendant’s identity at the Defendant’s residence in G in the city of Nurung-ri, the Nurung-ri of China.
