1. The Defendants shall jointly and severally pay to the Plaintiff KRW 400,000,000 and the interest rate thereon from February 18, 2016 to the date of full payment.
In addition to the overall purport of the pleadings in the evidence Nos. 4 and 5, the Defendant Company B (hereinafter “Defendant Company”) prepared and delivered to the Plaintiff a letter of commitment to pay KRW 400 million (15% per annum of agreed delay damages) to the Plaintiff on or before December 31, 2015, and ② Defendant C may recognize the fact that the above payment obligation of the Defendant Company was jointly and severally guaranteed.
Therefore, the Defendants are jointly and severally liable to pay to the Plaintiff damages for delay calculated at the rate of 15% per annum, which is the agreed damages for delay, from February 18, 2016 to the date of full payment, with the above KRW 400 million and the following day of maturity.
If so, the plaintiff's claim is accepted.
