(2) Article 208(3)2 of the Civil Procedure Act applies mutatis mutandis to the case where “creditor” is “Plaintiff,” and “debtor” is “Defendant,” respectively. The Defendant is only served the original copy of the payment order and submitted the formal written objection, and the Defendant did not appear on the date for pleading after the submission of a written response. Thus, the Plaintiff’s assertion is deemed to have been led to a confession under the main text of Article 150(3) and the main text of Article 150(1) of the Civil Procedure Act.
