1. The Defendants jointly and severally distribute to the Plaintiff KRW 400,000,000 as well as Defendant original distribution from January 1, 2014.
Comprehensively taking account of the respective descriptions and arguments in subparagraphs A and 4, Defendant A Co., Ltd. (hereinafter “Defendant A”)’s statement that the Plaintiff shall pay KRW 400,000,000 of the raw material purchase price that was not paid to the Plaintiff until December 31, 2013 (Evidence A 2-1) was prepared by the time when the Plaintiff was drafted, it can be acknowledged that the internal director B, the representative of Defendant A, issued the Plaintiff a corporate seal imprint and his personal seal imprint certificate to the Plaintiff.
In light of the above facts, it can be recognized that the defendant A, the representative of the defendant A, has prepared a repayment plan, so the authenticity of the evidence No. 2-1 can be recognized.
Therefore, according to the purport of the evidence No. 2-1 and the entire pleadings, it is acknowledged that the Defendants agreed to pay 400,000,000 won to the Plaintiff, a company engaged in livestock product distribution business, from June 5, 2013 to December 31, 2013, as the Plaintiff, a company engaged in meat processing and distribution business, to pay 400,000,000 won for unpaid raw material land of the Defendant Original Distribution Co., Ltd. (hereinafter “Defendant Original Distribution”). Thus, the Defendants are jointly and severally liable to pay the Plaintiff 40,000,000 won to the Plaintiff from January 1, 2014 to June 16, 2017, the delivery date of a copy of the complaint of this case, and from July 30, 2017, the delivery date of a copy of the complaint of this case to the Defendant Chang Chang Chang Distribution Co., Ltd., Ltd., to each of the following 5% annual damages from the day of delivery of the complaint of this case.
Therefore, the plaintiff's claim against the defendants of this case is justified, and all of them are accepted, and it is so decided as per Disposition.
