1. 3. 피고인은 제2항 기재 일시로부터 며칠이 지난 후 제1항 기재와 같은 장소에서, 위 피해자가 샤워를 하기 위해 화장실에 들어가자 피해자를 따라 화장실에 들어간 후 피해자에게 “나도 핥아줬으니 너도 핥아봐라”라고 말하여 피해자로 하여금 피고인의 성기를 핥게 하는 방법으로 추행하였다.
