1. Of the real estate listed in the attached Table 1 list to the Plaintiff

Reasons

1. Factual basis

A. On December 29, 1993, D transferred the ownership of real estate listed in the separate sheet No. 1 (hereinafter “instant real estate”) due to sale and purchase, but completed the registration of ownership transfer due to inheritance by consultation and division on May 28, 2009.

On May 16, 2015, Plaintiff and F entered into a sales contract with E with respect to each of the instant real estates, and completed the registration of ownership transfer on July 17, 2015.

B. On July 5, 2001, Defendant C entered into a lease agreement with D on a deposit of KRW 5,00,000, monthly rent of KRW 350,000, and from July 5, 2001, on a deposit of KRW 24 months between E and E on a deposit of KRW 2,00,000, monthly rent of KRW 40,000, and period of lease of the instant real estate from December 31, 2012, Defendant C occupied and used the instant real estate by concluding a lease agreement with a period of KRW 12 months from December 31, 2012.

다. 피고 B는 2013. 6. 10. E과 이 사건 부동산 중 지하, 1층, 2층, 3층 전부에 관하여 보증금 2,000,000원, 차임 월 400,000원으로 정하고 임대차기간은 정하지 않은 채 임대차계약(이하 ‘이 사건 임대차계약’이라고 한다)을 체결하고, 임대차계약서에 피고 C를 거주자로 기재하여 피고 C로 하여금 위 부동산 중 지하 1층, 지하 2층, 1층, 2층의 각 별지 3 도면 표시 계단의 북쪽 부분(각 층 ㉠, ㉡, ㉢, ㉣의 각 점을 차례로 연결한 선내 부분) 64.635㎡, 60.71㎡, 98.01㎡, 56.325㎡를 계속 점유, 사용하게 하고, 자신은 그 중 별지 2 도면 표시 ㉦, ㉧, ㉢, ㉫, ㉦의 각 점을 차례로 연결한 선내 10㎡를 점유, 사용하고 있다.
