1. Facts recognized;
A. Around February 2003, the network A entered into an insurance contract and its content 1) with the Plaintiff, and around August 2003, the Defendant entered into an accident insurance contract (attached Nos. 1.), and around August 2003, the pleasure of non-distribution (attached No. 2.) with the Plaintiff, respectively. (2) Of the above two insurance contracts, the parts relating to the instant case are as follows.
(1) Where the coverage coverage amount of an accident insurance coverage during the period of non-dividend freedom is recognized as fixed based on the diagnosis of a doctor on the date 180 days from the date of the accident, and the rate of payment of the remaining disability shall be determined as the rate of payment of the remaining disability in the event of death or remaining disability (the payment of disability less than 80% shall be multiplied by the disability payment rate) in the event of death or other general injury caused by an accident other than death of the beneficiary at the time of death of the beneficiary.
(Article 16(3) of the General Terms and Conditions of Accident Insurance in the era of Non-Distribution Freedom.
