[2] Notwithstanding that the Defendant did not have an intent or ability to act as an intermediary for sexual traffic with C, the Defendant, along with C, intended to act as an intermediary for sexual traffic, the Defendant, using the word “Seoul Stockholm”, to act as intermediary for sexual traffic to the victims by arranging sexual traffic.

The role leading up to the false statement, C shared the role of receiving victims from sexual traffic brokerage fees at the place where C had induced, and conspired to flee with C (hereinafter “the instant fraudulent sex trafficking brokerage fraud”). The Defendant, following the Defendant’s deception with C, pursuant to the instant fraudulent sex trading arrangement with C, connected to the Flux case called “Uh Stockholm” using the mobile phone of Busan Southern-gu, Busan-gu, on October 13, 2017, on the road before the Busan-gu, Busan-gu, the fact that: (a) had access to the Flux case using E’s mobile phone, despite the lack of intent or ability to arrange sexual traffic, the Defendant would arrange and arrange sexual traffic to the victim F despite the absence of the intent or ability to arrange sexual traffic.

이에 C은 같은 날 22:00 경 위 장소에서 피해자 F, G을 만 나 성매매 명목 비로 피해자 F, G으로부터 1 인 당 22만원 씩 총 44만원을 교부 받기 위해 부산 부산진구 H 오피스텔로 가 던 중 피고인 및 C이 성매매를 시켜 줄 수 없다는 것을 알아챈 피해자 F, G에게 발각되는 바람에 그 뜻을 이루지 못하고 미수에 그쳤다.

Accordingly, the Defendant and C had attempted to receive property from the victim F and G by deceiving the victim F and G, but did not bring about such intent.
