If a person who has raised an objection to a distribution schedule fails to appear on the first date for pleading of a lawsuit of demurrer against distribution (Articles 268 and 158 of the Civil Execution Act), the said lawsuit shall be deemed to have been withdrawn (see Articles 268 and 158 of the Civil Execution Act), and the fact that the Plaintiff did not appear on March 19, 2015, which is the first date for pleading, is apparent in the record. Therefore, the instant lawsuit was concluded on March 19, 201
Therefore, it is decided as per Disposition by the Plaintiff’s declaration of termination of the lawsuit regarding the Plaintiff’s application for designation of the date of this case.
