1. On January 13, 2015, the Defendant: (a) on each real estate listed in the separate sheet to the Plaintiff, the Suwon District Court Yang Jong-gu Office.
Basic Facts
A. 1) C is a project agreement signed between C and the Defendant on October 2014, 2014; and C is a forest of 56,430 square meters in the E forest of e in the form of harmony from D, etc. (hereinafter “the forest of this case”).
2) While the Defendant entered into a contract to purchase KRW 3.5 billion, and paid KRW 350 million for down payment. 2) While having experienced difficulties in creating any balance for the forest land in the instant chemicalization, C provided that the Defendant prepared KRW 80 million and promised to pay KRW 1.6 billion to the Defendant six months after the face of each week.
3) In accordance with the aforementioned commitments, the Defendant drafted a business agreement with C on January 8, 2015 (hereinafter “instant business agreement”).
The main contents of the above business agreement are as follows. C, the Defendant, for the sake of real estate development project on the following land, shall agree on the basic matters for the project and enter into this agreement. Article 3 (Business Method) ① The land in the name of the Defendant shall conduct the project, and the Defendant shall conduct the project as a joint business proprietor. Article 4 (Raising Funds): The Defendant’s Funds: Article 5 (Distribution of Funds): 1.6 billion won (Distribution of Funds): (1) The Defendant shall preferentially receive dividends of KRW 1.6 billion within one to two months after July 6, 2015. Article 6 (Disposition of Taxes and Taxes) ① The amount of land arising under the name of C, taxes and public charges imposed in connection with the land, and financial expenses shall be borne by C. Article 7 (Cancellation of Agreement) and the Defendant may terminate the business agreement in the following cases. ② The Defendant shall not pay dividends agreed upon to the Defendant by February 28, 2016 to the seller of forest land and transfer the right to the said land to C on the date of completion of the registration of transfer of ownership transfer.
5 C As to the forest land in the instant case for the purpose of securing obligations under the project agreement on the date of the transfer of ownership.
