The defendant shall be innocent.
Reasons
1. At around 17:35 August 3, 1993, the Defendant, an employee, refused to comply with the Defendant’s demand for measurement of C cargo vehicles on the road prior to the front of the red diversary type of movement in the Yancheon-gun, Chungcheongnam-gun, Gyeongcheon-gun, Gyeongcheon-do.
2. Determination on the constitutionality of Article 86 and subparagraph 2 of Article 84 of the former Road Act (amended by Act No. 4545, Mar. 10, 1993; Act No. 4920, Jan. 5, 1995); the Constitutional Court Decision 201Hun-Ga18, Oct. 25, 2012; the former part of Article 325 of the Criminal Procedure Act is acquitted.
