A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. The Defendant is a person who was the chairman of the Emergency Countermeasures Committee of the Housing Redevelopment and Improvement Project Association in Ansan-si B during the period of Ansan-si.
On February 2, 2016, the Defendant stated that “In order to hold a general meeting for dismissal of executive officers of C&A, the number of members to reach 1,460 is insufficient to hold the general meeting.” The Defendant stated that “In order to provide funds to hold the general meeting. If the head of the association is elected, the Defendant would enter into a contract for removal of the building in C and relocation management services with the party.”
However, in fact, the Defendant did not have the intent, ability, or qualification to leave the above redevelopment association president election, and thus, was promised to remove buildings and conclude a relocation management service contract, as agreed by the victim. The Defendant had already entered into the redevelopment association with various enterprises, such as E, F, G, H, and I, and the said redevelopment association entered into a removal and relocation management service contract, and the Defendant did not have to enter into the said redevelopment association with the victim under the condition that it entered into a removal and relocation management service contract.
Nevertheless, the Defendant, by deceiving the victim as such, had the victim pay the total sum of KRW 122,475,000 from March 22, 2016 to September 12, 2016, and had the victim pay the total sum of KRW 122,475,00 from around March 22, 2016 to around September 12, 2016 to acquire property

2. The Defendant was a person who was the chairperson of the Emergency Countermeasures Committee of the Housing Redevelopment and Improvement Project Association in B B in Ansan-si, and D as the representative director of JJ, the Defendant was a service contract for the removal of officers of the partnership.
On June 28, 2018, the Defendant was a witness of the Seoul Western District Court located in Mapo-gu Seoul Mapo-gu, Seoul, as a witness of the fraud case (2018 Godan715) against D.
