1. The Defendants jointly do so to the Plaintiff:

Reasons

1. Facts of recognition;

A. On July 24, 2018, the Plaintiff, among the buildings listed in the separate sheet, leased all the first floor commercial buildings to the Defendants as KRW 50 million, the period from July 26, 2018 to KRW 3,50,000 (excluding value-added tax). On the same day, the Plaintiff handed over the said building to the Defendants on the same day.

B. The Plaintiff and the Defendants agreed that the contract may be terminated in the event that the Plaintiff and the Defendants were in arrears for not less than three months from Article 3 of the above lease agreement and the special agreement.

C. On September 20, 2018, the Defendants paid KRW 4,950,00 as the monthly rent of KRW 1,000,000,000 to the Defendants, and were in arrears for a period of four months until December 25, 2018. The Plaintiff expressed his/her intention to terminate the lease contract by serving a duplicate of the instant complaint on the Plaintiff.

Until the closing of argument, the Defendants paid to the Plaintiff KRW 4.5 million on January 10, 2019, ② KRW 10 million on June 11, 2019, ③ KRW 5 million on August 30, 2019, ④ KRW 10 million on September 2, 2019, respectively.

2. 판단 위 인정사실에 따르면, 원고와 피고들 사이의 임대차계약은 피고들의 차임 연체에 따른 원고의 해지 의사표시에 따라 이 사건 소장 부본 최종송달일인 2019. 1. 27. 적법하게 해지되었으므로, 피고들은 공동하여 원고에게 임대차계약 해지에 따라 ① 별지 목록 기재 건물 1층 중 별지 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉤, ㉥, ㉦, ㉠의 각 점을 순차로 연결한 선내 81.47㎡을 인도하고, ② 원고가 구하는 바에 따라 2019. 2. 26.부터 2018. 7. 26.부터 2019. 2. 25.까지 7개월 동안의 차임 및 부가가치세 합계 3,465만 원(= 495만 원 × 7개월)에서 지급받은 총 금액인 3,445만 원(= 495만 원 450만 원 1,000만 원 500만 원 1,000만 원)을 제하면, 20만 원이 남으나, 원고는 이를 청구하지 않겠다는 취지로 진술하였다.
