1. Basic facts
A. The Plaintiff is a real estate broker who runs the real estate brokerage business under the trade name of “E Licensed Real Estate Agent” (hereinafter “instant brokerage office”) in the building located in Dongjak-gu Seoul Metropolitan Government.
B. Defendant B is the husband of J, who is the owner of the second floor H or I of the G building on the ground of the fourth floor outside the Seoul, Dongjak-gu Seoul Metropolitan Government (hereinafter “instant real estate”). Defendant B requested the sale brokerage of the instant real estate to the neighboring real estate brokers, including the Plaintiff.
C. On January 10, 2017, the Plaintiff registered the instant real estate on the Internet website as a package, and Defendant C visited the instant brokerage office to request the purchase and brokerage of the instant real estate for operating the dental hospital.
Around February 10, 2017, the Plaintiff arranged the Defendants’ remainder, notified Defendant C of the management expenses, parking expenses, and banking loans of the instant real estate by telephone or text message. Around February 10, 2017, the Plaintiff, the Defendants, and Defendant C’s wife K agreed on the sales contract at the instant brokerage office.
The purchase price of the instant real estate presented by the Plaintiff to Defendant C was KRW 3.5 billion.
E. On February 28, 2017, the Plaintiff and Defendant C sent several text messages to the Plaintiff regarding the sale and purchase of the instant real estate, and Defendant C refused to do so by Defendant C, even though the Plaintiff introduced another building located in Seoul L, around March 3, 2017, by introducing a text message to the Plaintiff on the same outline as “I would like to jointly purchase one life. I would like to make it difficult to proceed with the work like A representative (Plaintiff) due to a lot of concerns to be considered. There are various kinds of issues.”
F. Between Defendant B’s wife and Defendant C’s wife K and Defendant C’s branch M, the broker of Licensed Real Estate Agent N (O Licensed Real Estate Agent Office) around February 28, 2017.
