A. The Plaintiff is a corporation that runs the real estate brokerage business, etc.; D is its representative; Defendant B is a corporation that runs the business of manufacturing and selling ready-mixed; Defendant C is the representative director of Defendant B; Defendant F is a corporation that is the representative director of Defendant B; Defendant C owns 60% of the shares of Defendant B’s related company F; and Defendant C’s wife owns 5% of the shares of Defendant B; and 30% of the shares of Defendant B are owned by Defendant C, and Defendant C’s wife.

G is its representative, and H is a corporation that runs the business related to ready-mixed, asphalt, and tin acid, and I is its representative, and J is its father and son.

B. On March 17, 2017, K’s business division L, a creditor of H, had the intention to purchase the land owned by H and its related parties, such as Sejong-si, the third-si land owned by H, I, and J (hereinafter “each of the instant real estate”), and the third-party land owned by H, H, and his related parties. G, Defendant C had a positive response. The location, area, officially announced land price, appraised value, expected sales price, and the establishment of a collateral security.

C. Since L delivered I’s intention to sell to G and Defendant C, G and Defendant C are the former duties of H at the time I and N on June 23, 2017;

L and Man or each of the instant real estate was agreed to sell KRW 32,000,000 for the price, and the Plaintiff did not participate therein.

On the other hand, Defendant C agreed that part of the purchase price I and the above shall be paid in cash held by Defendant C on the same day, but the remainder shall be paid upon receiving a loan from a financial institution after completing the registration of ownership transfer for each of the instant real estate.

On June 26, 2017, N provided Defendant C with data containing the current status and land cadastre of each of the instant real estate.
