The punishment of the court below against the defendant (one year and two months of imprisonment) is too unreasonable.

Judgment

The defendant has no record of punishment except for the previous convictions of this kind, and the fact that the mistake is divided. However, the crime of this case is serious that the defendant, a licensed real estate agent, obtained a total of 80 million won against many victims by using his status and uses the document in the process of the crime of this case by forging it, and the defendant did not agree with the victims and did not pay damages, and all the sentencing conditions specified in the records and arguments of this case, such as the defendant's age, character and behavior, environment, criminal background, circumstances after the crime, etc., shall not be deemed to have any heavier punishment sentenced by the court below.

In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
