A The head of Defendant B (hereinafter referred to as the “Defendant Company”) is a person responsible for overall control of affairs such as sending letters and sending civil petition calls, and the Defendant Company is a corporation established for the purpose of special category telecommunications business, etc., which provides a service for conversations with women employed by a male user after receiving 60 telephone service numbers from Onnuri Telecom Co., Ltd. (hereinafter referred to as fixed-term telecommunications companies) by contract assignment of 60 telephone service numbers from Onnuri Telecom Co., Ltd. (hereinafter referred to as “Defendant Company”).

No person shall transmit information about media products harmful to juveniles under the age of 19 to juveniles in the form of code, letter, voice, sound, image, etc. using an information and communications network or openly exhibit information about goods or services prohibited by the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. or any other Act through an information and communications network without any measures restricting access by juveniles.

A notice of the Juvenile Protection Committee and the Ministry of Gender Equality and Family has been given to the Commission on Youth Protection and the Ministry of Gender Equality and Family to designate a telephone number of voice dialogue service (phone hosting, telephone room, image room, video hold room, and similar service) between unspecified users or between unspecified users and their employees as media products harmful to juveniles. The telephone information service provided by the Defendant A (phone 060) is a media product harmful to juveniles.

Nevertheless, Defendant A established the Defendant Company on April 7, 2010 to advertise telephone information service (udio-recording) numbers, which are media products harmful to juveniles, and printed the phrase “sexual intercourse” on paper cups, and 060 voice hosting numbers in order to distribute them in the entertainment areas of Seoul and local cities, or display them on the hand of the parked vehicles.
