The prosecution of this case is dismissed.
Reasons
1. 공소사실의 요지 피고인은 2012. 11. 5. 12시 39분경 서울 성북구 B고등학교 행정실에서 학내 메신저를 이용하여, 피해자 C가 사용하는 메신저 쪽지로 'C야~나랑 하룻밤 자자~'라고 하여 통신매체를 통하여 피해자에게 성적수치심과 혐오감을 일으키는 글을 도달하게 하였다.
2. Determination
(a) An offense subject to prosecution on complaint: Articles 12 and 15 of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes;
B. Revocation of complaint filed by the victim C on February 19, 2013 after filing a prosecution;
(c) Judgment dismissing public prosecution: Article 327 subparagraph 5 of the Criminal Procedure Act;
