The prosecutor's appeal is dismissed.
1. Comprehensively taking account of the evidence submitted by the Prosecutor’s summary of the grounds for appeal (misunderstanding of the facts and misapprehension of the legal principle as to the conflict), the Defendant informed the victims of harm and injury as if the Defendant, without authority, by using force, demanding a force to prevent the victims from doing business in a tent, etc., and the victims delivered money and valuables to the Defendant under the pretext of a tent. As such, the victims were sufficiently aware of the facts charged of the conflict against the victims, but the lower court was sufficiently aware of the facts charged of the conflict against the victims, and thus, given money and valuables by the victims,
For the reasons that it is difficult to see that the defendant was acquitted, the court below erred by misunderstanding facts or by misapprehending the legal principles, which affected the conclusion of the judgment.
2. Determination
A. The summary of this part of the facts charged is that the Defendant is engaged in the secondary sales business in D.
The Defendant, in the form of a tent (2m, 4m wide) installed on the side of the Gangnam-gu Seoul Metropolitan Center D A Dong 'E Center' (2m wide, 4m long) in Gangnam-gu, will do so as his own tent, and will prevent funeral services without paying the price.
"Intimidating to receive money by intimidation".
