Defendants are not guilty.
1. On November 15, 2017, this court rendered a judgment of innocence against two operators of food service companies related to the instant case and 24 operators of the kindergarten and child-care centers who were refunded the amount equivalent to the food supply cost from them (see, e.g., Supreme Court Decisions 2016Da1648, Nov. 15, 2017; 2398, Jul. 2398, 2016; 140, Nov. 28, 2016; 24 operators of the above kindergarten and child-care centers). The indictment against the above 24 operators of the kindergarten and child-care centers was separately filed on August 10, 2017.
A. Occupational Defendant A is a person who operates a D kindergarten in Ulsan-gu, Ulsan-gu, and Defendant B is a person who operates a F kindergarten in Busan-gu, Busan-do.
B. When an operator, such as the head of a kindergarten for the crime of Defendant A, receives educational expenses borne by beneficiaries (expenses borne by the parents for the operation of kindergarten curriculum), such as meal expenses, the education expenses borne by beneficiaries shall be used only for 1:1 expenses, such as school meal expenses, and the specific details of use shall be notified to the steering committee comprised of the representatives of parents, etc. and subject to deliberation and resolution by this steering committee. The decision shall be notified to the guardians. Additional expenses, such as education expenses borne by beneficiaries, etc., shall be compiled in the budget so that revenue and expenditure can coincide with each other. Such additional expenses, such as education expenses borne by beneficiaries, etc. shall not be diverted, and the expenses shall be deposited into an exclusive kindergarten account and reported to the office of education that is the supervisory office, and the details of use shall be notified to the parents, and the balance shall be settled and returned to the parents within 10 days after the completion of the relevant
Defendant 1 supplied food materials to Busan, Ulsan, Ulsan, Gyeongnam, and child-care centers, including the above D kindergarten.
G (Detentions by Detention on September 26, 2016) and H (Non-Detentions by Detention on September 26, 2016) make up the amount of food materials, and the difference is kindergarten.
