Defendant shall be punished by a fine of KRW 700,000.
If the defendant does not pay the above fine, the amount of KRW 100,000 shall be paid.
Punishment of the crime
The defendant is a person who operates "D" in Sungnam-si, Ma, and "D" is a general restaurant, which is operated for the purpose of selling alcoholic beverages rather than cooking and selling food.
Among general restaurant businesses, a business store operated in the form of a small kitchen, cap, etc. for cooking and selling alcoholic beverages shall not be a business establishment harmful to juveniles, and no person who operates such a business shall employ juveniles, and the person who intends to employ employees shall verify his/her age in advance
Nevertheless, from around 20:00 on March 31, 2016 to 23:30 on the same day, the Defendant promised the aforementioned “D” to pay the above “D” amounting to KRW 6500,00 at the time of wage of KRW 650.

1. The defendant and his defense counsel asserted that they had no intention to employ juveniles to harmful business establishments, as they stated the number of adult F's resident who is a undergraduate student and employed E to believe that they would be a harmful business establishment.

In light of the legislative purpose of the Juvenile Protection Act, the business owner of a business establishment harmful to juveniles has a very strict responsibility for not employing juveniles in the business establishment concerned for the protection of juveniles. Thus, when the business owner of a business establishment harmful to juveniles employs employees in the business establishment concerned, the business owner of the business establishment harmful to juveniles must verify the age of the subject based on the resident registration certificate or evidence with public probative value of age sufficient to the degree of age. If there is doubt that the photograph and the actual object of the business are different from those of the resident registration certificate presented by the subject, the case where the juveniles are able to see their own identity and age and see employment of the business establishment harmful to juveniles in light of the vulnerable employment conditions of the business owner.
