A. The summary of the facts charged is that the Defendant collected KRW 150 million from the investor F of the medical corporation E, who actually operates the victim D by telephone at a non-police place on January 2014.

In order to make an investment of KRW 150 million, the said foundation made a false statement to the effect that it would be in charge of disaster, such as the chief director, and the operation of the G convalescent Hospital of the said foundation.

However, in fact, the defendant only thought that the defendant would use it as operating funds, such as expenses for extension of G convalescent and payment of health insurance premiums, in return for money from the injured party, and there was no intention to register the victim with the president of the said Foundation or to take charge of the operation

The Defendant, as such, by deceiving the victim, received KRW 150 million from the victim, to the Agricultural Cooperative Account (H) in the name of the said Foundation around the 23th of the same month.

B. The defendant and his defense counsel asserted that the defendant invested the investor F's investment share of KRW 150 million to the complainant and did not take charge of the operation of the convalescent hospital of the above foundation, and that the defendant did not actually take charge of the operation of the convalescent hospital of the above foundation.

According to the following circumstances revealed through the records of this case, the complainant's assertion that the complainant paid interest of KRW 150,000 to the defendant, and registered as the president, and at the same time, paid monthly pay of KRW 18,000,000 per month in charge of the operation of the hospital, and if the defendant paid the above KRW 150,000,000,000,000 to the principal director, he would not be paid the above KRW 1,50,000,000,000,000,000 to the borrower, and it seems that it would be inevitable that the amount exceeds the representative status and the right to operate the hospital of KRW 1,50,00,00,000 to the first police officer of September 2013, the defendant would pay interest to the first police officer upon investing
