Inasmuch as Article 35 of the Criminal Act does not violate the principle of prohibition of double punishment or the principle of equality under the Constitution solely on the grounds pointed out in the grounds of appeal (see Supreme Court Decisions 89Do2227, Jan. 23, 1990; 201HunBa2, 374, Sept. 26, 2013; 2012HunBa262, 374, Sept. 26, 2013) on the grounds of appeal, we cannot accept the grounds of appeal that the above provision is unconstitutional

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
