1. The Defendant shall pay to the Plaintiff KRW 38,620,650 as well as 12% per annum from April 4, 2019 to the date of complete payment.
Comprehensively taking account of the overall purport of the pleadings in Gap evidence Nos. 3 and 4-1 through 7, the plaintiff supplied the defendant with goods equivalent to KRW 104,480,750 from July 17, 2018 to February 21, 2019, and received KRW 64,475,700 from the defendant, the defendant returned goods equivalent to KRW 701,800 on April 8, 2019, and KRW 105,600 on May 7, 2019. The plaintiff's burden of returning KRW 23,000,000 on food requested by the plaintiff, and the amount of KRW 60,000 should be excluded from the amount of food supplied by the plaintiff from KRW 38,597,650 on food to February 21, 2019. According to the above acknowledged facts, the defendant is obligated to pay the plaintiff the total amount of KRW 38,597,600 on the following day of delivery, 20008.
As to this, the Defendant returned goods equivalent to KRW 95,700, including KRW 52,800, October 22, 2018, and KRW 42,900, December 17, 2018, the Defendant’s submission of documents by the Defendant alone is insufficient to acknowledge this, and there is no other evidence to acknowledge this.
If so, the plaintiff's claim shall be accepted for the reasons of the judgment as per Disposition.
