1. The summary of the facts charged in this case is that the Defendant, as the representative of “G”, submitted a business plan to the effect that “I will supply seeds and seedlings produced in H fishing village fraternity (the location of the water: I branch line in the Sinnam-do, Chungcheongnam-do, Chungcheongnam-do), J fishing village fraternity (K branch line in Chungcheongnam-do),” and the above two fishing village village fraternities from the Cheongjin-gun Office and the above two fishing village fraternities and the above two fishing village fraternities, upon prior examination, supplied seeds and seedlings 160,714kggs produced in the above fishing village fraternities around June 4, 2013, and received a successful bid under the condition that I will receive KRW 49,90,290,000 (hereinafter referred to as “Ig”) from the above fishing village fraternities and the above two fishing village fraternities and receive a successful bid on June 4, 2013 (the above fishing village fraternities).
Nevertheless, from June 8, 2013 to June 30, 2013, the Defendant distributed approximately 108,588 gggs for seeds and seedlings produced by H fishing village fraternities and J fishing village fraternities, which were specified at the time of winning the contract, in which the quantity of the seeds and seedlings produced by the H fishing village fraternities and J fishing village fraternities is not sufficiently secured. From June 8, 2013 to June 30, the Defendant spread approximately 52,126 ggs for seeds and seedlings collected from the tidelands around the Heungjin power plant, and spread the seeds and seedlings collected from the Jung-gun, Incheon Jung-gun, Spo-gun, Spono-do pool.
The Defendant, as seen above, spread approximately 52,126 km from a production site that does not meet the conditions set forth in the business plan at the time of winning the contract, to a tideland located in the area around a tideland in the vicinity of the Yeongdeungpo-do Power Station, and around July 1, 2013, the Defendant claimed the payment of the price, as if the 160,714 km were all collected from the H fishing village fraternity and the J fishing village village village joint cultivation site, which was distributed to M in the person in charge of the department of the Jinjin-gun of Incheon Metropolitan City, 5 Dong-gu, Incheon, 627-608.
