On December 4, 1997, the Hanyang Credit Union established and lent 20,000,000 won to D, until November 26, 1999, interest rate of 14% per annum, and damages for delay rate of 20% per annum, respectively, and B and E jointly guaranteed the obligations of the above loans to the Yangyang Credit Union.

B. The Korea Deposit Insurance Corporation in bankruptcy of the Yang Credit Cooperatives, upon D's failure to repay the above loan debt, filed a lawsuit against D, B, and E claiming a loan against the Daejeon District Court 2002 Asan City court 20676. Accordingly, on October 8, 2002, "B and E shall jointly and severally pay 19,310,000 won and interest rate of 20% per annum from December 31, 1998 to the date of full payment" was decided and the above decision becomes final and conclusive at that time. After that, the Plaintiff acquired the above loan debt against B, while the Plaintiff's demand for the repayment of debt was insolvent.

C. F and G owned 1/2 shares of each of the 664 square meters (hereinafter “instant real estate”) before Asan-si, Asan-si. However, on July 29, 199, B was awarded a successful bid for 1/2 shares owned by G during the compulsory auction procedure.

B entered into a pre-sale agreement with H on October 6, 199 on the share of 1/2 of the instant real estate and made a provisional registration of the right to claim ownership transfer (hereinafter “provisional registration of this case”) on October 7, 1999 as the ASEAN Branch Office of the Daejeon District Court on October 7, 1999.

E. On April 6, 2009, H transferred the right on the provisional registration of this case to the Defendant on the ground of the transfer, and completed a supplementary registration of transfer of right on the provisional registration under the Act No. 17198 of the receipt on April 7, 2009 by the Daejeon District Court of Daejeon District on the ground of the transfer. The I transferred again the right on the provisional registration of this case to the Defendant on February 2, 2012.
