The judgment below

In light of the records, the court below reversed the judgment of the court of first instance which found the defendant guilty on the damage of property among the facts charged of this case on the ground that there is no proof of crime, and sentenced the defendant not guilty on the grounds of the judgment below is just. Contrary to the allegations in the grounds of appeal, the court below did not err by misapprehending the principle

On the other hand, the prosecutor appealed against the guilty portion of the judgment of the court below, but does not state the grounds for objection to this portion in the petition of appeal and appellate brief.

Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
