A defendant shall be punished by imprisonment for not less than one year and six months.
7,400,000 won shall be additionally collected from the defendant.
Punishment of the crime
1. Purchasing philophones;
A. On September 8, 2013, the Defendant: (a) transferred KRW 3.5 million to E and received approximately 10 grams of Metepopa (one name, penphone; hereinafter “philopaphone”); and (b) Mepopa, a local mental medicine, in E’s vehicle parked in the exit No. 5 D Station in Gangnam-gu Seoul, Seoul; and (c) received approximately 10g of Melopa.
Accordingly, the defendant purchased philophones.
B. On January 12, 2014, the Defendant received approximately 1.8 million won in the “G” guest room located in the Gwanak-gu Seoul Special Metropolitan City F, H, and approximately 5 g of phiphones.
Accordingly, the defendant purchased philophones.
(c)
The Defendant, around February 8, 2014, received approximately KRW 170,000 from JW and H 170,000,000 from the Defendant, located in Seoul Special Metropolitan City, Gwanak-gu.
Accordingly, the defendant purchased philophones.
(d)
On February 2014, the Defendant received approximately KRW 400,000,000 from JW, and H, located in Gwanak-gu, Seoul Special Metropolitan City, for approximately 0.7 grams.
Accordingly, the defendant purchased philophones.
2. Receipt, medication, etc. of philophones.
A. On September 9, 2013, the Defendant provided L free of charge approximately 0.2 g of philophones contained in the disposable injection machine at his house located near the Seoul Special Metropolitan City, Gwanak-gu.
Accordingly, the defendant accepted philophones.
B. On October 15, 2013, the Defendant injectedd approximately 0.05g of oponphones, along with L, to their arms by dilution them into a single-use injection machine.
Accordingly, the Defendant conspired with L to administer philophones.
(c)
On October 16, 2013, the Defendant injected approximately 0.05g of philophones, along with L, into one-time divers, into their arms by dilutioning aquatic plants.
Accordingly, the Defendant conspired with L to administer philophones.
(d)
From January 2016 to January 29, 2016, the Defendant: (a) 1101 heading rooms of Speaker-si Ntel 1101; and (b) dilution of philophones with water, or injected them into their body.
