Reasons

The summary of the facts charged in the instant case is as indicated in the separate facts charged. This is a crime falling under Article 311 of the Criminal Act, which can be prosecuted only when the victim files a complaint pursuant to Article 312(1) of the Criminal Act. According to the records, since the complainant B was recognized to have withdrawn the complaint against the Defendant around January 11, 2017, the indictment of this case is dismissed in accordance with Article 327 subparag. 5 of the Criminal Procedure Act and is so decided as per Disposition.
