A. The Defendant is a housing reconstruction association established pursuant to the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”) for the purpose of promoting housing reconstruction projects for apartment and commercial buildings in Gangdong-gu Seoul Metropolitan Government, including real estate listed in the attached list (hereinafter “instant real estate”). The Plaintiff was the owner of the instant real estate and did not join as the Defendant’s member.

B. 1) On July 3, 2012, the Defendant filed a lawsuit claiming ownership transfer registration against the owner of the above housing reconstruction project site including the Plaintiff (Seoul East Eastern District Court 2010Gahap20578). On the Defendant’s claim against the Plaintiff, on December 2, 2012, the lower court rendered a judgment that “the Plaintiff paid KRW 147,70,000 to the Plaintiff,” and at the same time, the Plaintiff performed the procedure for ownership transfer registration on the instant real estate on December 2, 2010, and delivered the said real estate.” 2) Accordingly, the Plaintiff appealed (Seoul High Court 2012Na70151) (Seoul High Court 201), and the said appellate court received KRW 156,80,000 from the Defendant, and changed the ownership transfer registration on the said real estate to the Defendant on April 18, 2013.”

On July 22, 2015, the Plaintiff’s photograph (for confirmation of delivery), written judgments, confirmation confirmation sources, registration rights certificates (certificate), registration delegation forms, certificates of personal seal impression for sale, resident registration card copies, identification card copies, and certificates of the payment of electric charges in Seoul Eastern District Court (No. 15, 2015).
