On August 9, 2012, the Defendant was sentenced to one year of imprisonment with prison labor or three years of suspension of execution due to a violation of the Narcotics Control Act in the Goyang Branch of the Jung-gu District Court on August 9, 2012. On November 24, 2014, the Defendant was sentenced to one year and four months of imprisonment with prison labor for a violation of the Narcotics Control Act at the Jung-gu District Court on November 24, 2014, and the said judgment became final and conclusive on April 16, 2015, and the sentence of the said suspension of execution was terminated on August 26, 2016.

Criminal facts

Defendant is not a narcotics handler.

1. On June 3, 2017, the Defendant purchased a penphone with approximately KRW 375,00,00 from D at the residence of Yangju-si C 102, 401, and with approximately KRW 2.5 grams, a local mental medicine, (hereinafter referred to as “suphone”).

2. On June 4, 2017, around 13:00, the Defendant injected approximately 0.05g of oponphones in the second floor near the F Station located in Seoul Special Metropolitan City, Nowon-gu, with G, into a single-use injection machine and dilution with water, and continuously injected approximately 0.05g of oponphones that were dilution with G in the above manner.

3. On June 11, 2017, the Defendant: (a) parked in the parking lot of an I business establishment located in H in Yangju-si, Yangju-si; (b) provided that the Defendant received from K one-time injection device containing approximately 0.1g of philopon, which was purchased and held as above, free of charge.

4. On June 12, 2017, the Defendant sent the cost of express bus baggage from D, and received a proposal to request the search for an express bus baggage, and then accepted it.

The defendant is N in M in the same day, the Government of L in the same day, and 1.5 million won for penphones received from D, as N.
