A. Facts of recognition 1) The Plaintiff is a company engaged in the development, publication, distribution, and sales of software, and consulting and service business related to software. The Defendant is an online advertising agency business. (2) On July 2013, the Defendant entered into an advertising agency contract with A Co., Ltd. (hereinafter “Nonindicted Company”) on behalf of the Defendant for the Internet game advertising in the name of Nonparty Company B (hereinafter “instant advertising”). On September 2013, the Defendant entered into an advertising agency contract with the Plaintiff to act on behalf of the Plaintiff for the instant advertisement.

(4) According to the instant advertising agency contract concluded between the Plaintiff and the Defendant, the Plaintiff is obligated to make the instant advertising on behalf of the Defendant on the online sites, such as GDN (Guggglas Network), NAV, Cine, GG Game, Mara, Mara, Pato, Lyna, Game, Game Ca, Africa, African TV, etc. The Defendant is obligated to pay the Plaintiff the remainder of the advertising cost less a certain fee (GND: 15%, and 20%: 4%) from September 2013 to December 12 of the same year, pursuant to the instant advertising agency contract. The Plaintiff is obligated to pay the advertising fee that the Plaintiff did not receive from the Defendant, as indicated below, to pay the Plaintiff the remainder of the advertising cost (GND: 15%, and 20%).
