The defendant, along with AX, established a regional center of AY in Seoul, Busan, and Daegu, and provided investment explanation as if he could gain a lot of profits through the operation of the Internet gambling site, and conspired to attract investment funds from many investors.

On June 20, 2012, the Defendant told the victim BB at the BA hotel coffee shop located in Guro-gu Seoul Metropolitan Government to the effect that “Y Co., Ltd. is a company that creates profits by using sports soil games, and if it makes an investment, it would pay the profits equivalent to 10% of the main investment, and repay the principal after one month.”

However, the above company was established mainly for the wholesale and retail business of health auxiliary food, and its initial capital was limited to KRW 1,00,000,000, and its initial capital began to be used for the payment of interest to senior investors since the beginning by attracting 10% of the investment funds as interest for securing initial funds, and the investment funds received from junior investors began to be used for the payment of interest to senior investors, and the sports earth games was merely merely merely merely merely merely merely merely a subscription to attract investment funds from investors, and there was no intention or ability to make investors gain profits under an agreement so long as no new investment is continued.

In collusion with AX, the Defendant received KRW 70,00,000 from the AY Seoul Center, which was located in the BC apartment B 503 Dong on June 27, 2012, as investment money from the victim BB, by deceiving the victim BB as above, from September 5, 2012.
