1. The Defendants are jointly and severally liable to the Plaintiff for KRW 200 million and the Defendants B with respect thereto from August 3, 2019, and Defendant C with respect to November 2019.
In light of the fact that Defendant B borrowed KRW 200 million from the Plaintiff on April 8, 2016 under the joint and several surety of Defendant CD on April 8, 2016, Defendant B is jointly and severally liable to pay the Plaintiff damages for delay calculated at the annual rate of 12% per annum under the Civil Act from August 3, 2019 to November 7, 2019; Defendant C is from August 1, 2019 to August 9, 2020, respectively, and from January 10, 202, from January 10, 2020 to the day of full payment.
Defendant B, ① KRW 200 million, ② Party A’s evidence No. 1 was drafted compulsorily, ③ itself was also bankrupt, but there is no evidence to acknowledge it.
