The judgment of the court below is not reasonable in light of the following: although it is recognized that the defendant was aware of the crime of this case, the amount of fraud is up to 55 million won, the amount of fraud is not agreed with the victim, and even if considerable period has elapsed from the crime of this case, the damage recovery has not been made at all, and the defendant's age, character and conduct, the circumstances leading to the crime of this case, and the result, the circumstances before and after the crime of this case, and other various sentencing conditions as shown in the records and arguments of this case are considered as inappropriate.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
