1. The Defendant shall pay to the Plaintiff KRW 99,547,452 and a rate of KRW 24% per annum from December 3, 2014 to the date of complete payment.
Comprehensively taking account of the purport of the entire pleadings as to the evidence evidence Nos. 1 through 7, the Plaintiff agreed to lend KRW 154,00,000 to the Defendant on January 30, 2013, with the amount of KRW 154,90,000,000, but with the interest calculated at the rate of 9% per annum on the loan principal and interest thereon, the Plaintiff agreed to receive KRW 184,906,558 in installments for 48 months from March 8, 2013 to August of each month, and thereafter, upon the Defendant’s request, the Plaintiff agreed to receive KRW 9,547,452 and interest calculated at the rate of KRW 99,54,452 as of November 17, 2014 and interest calculated at the rate of KRW 24% per annum from December 2, 2014 to April 28, 2015.
According to the above facts, the Plaintiff is obligated to pay to the Defendant the above loan principal of KRW 99,547,452 and damages for delay at the rate of 24% per annum from December 3, 2014 to the date of full payment.
Therefore, the plaintiff's claim of this case is reasonable, and it is so decided as per Disposition.
