However, in fact, in order to open access roads with a width of 6 meters from the above land, it is necessary to purchase part of the land from H, I, and J or obtain approval for land use. However, the above H land owned by the Defendant except the above J land owned by K, which is the Defendant’s wife, and the above H land did not obtain approval for land use for the above I land owned by the new elevator company. In particular, since the above H land had an existing building, it was a situation where it is necessary to partially permit the existing building in order to open a road with a width of 6 meters, and it was a situation where it is practically impossible to expand the road of 6 meters in width.
