Anyone who intends to divert farmland in an agricultural promotion area shall obtain permission from the Minister of Food and Agriculture Affairs for the diversion of the farmland.

Nevertheless, on September 2013, the Defendant diverted the said farmland for the purpose of operating on the water surface without obtaining the aforementioned permission, by installing containers and pents, and laying the pents, etc. on approximately 2,183 square meters in Pyeongtaek-si, which is a site for a farm in the agriculture promotion area (farmland).
