On August 13, 2019, the defendant was sentenced to imprisonment for 8 months in the Seoul Southern District Court for fraud, etc., and on August 21 of the same month, the judgment becomes final and conclusive, and is still under the suspension of execution.

1. On May 2020, the Defendant: (a) obtained a copy of the FF Bank C Bank D points in Yongsan-gu Seoul, Yongsan-gu, Seoul; (b) obtained a copy of the F Bank C Bank C Bank D points; and (c) returned it to the victim; and (d) did not take any measures such as returning it to the victim.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

2. On May 14, 2020, the Defendant violated the Fraud and the Specialized Credit Finance Business Act, around 10:04, at the “I convenience store” located in Yongsan-gu Seoul, Yongsan-gu, Seoul, by purchasing one cigarette of “diskack tobacco,” and by deceiving the victim by presenting it to his employees in the name of the victim as if he had a legitimate right to use, and then settling the amount of KRW 4,500,00 from that time, until May 20, 2020, the Defendant paid KRW 224,60,000 in total nine times, such as the attached list of crimes (1).

Accordingly, the defendant, by deceiving the victims, acquired property or pecuniary benefits equivalent to the market value of 224,600 won, and used the lost check card.

3. The Defendant in violation of the thief and Specialized Credit Financial Business Act purchased one drinking water from the vending machine installed outside the 405 Seoul Han River as of May 14, 2020, the Defendant purchased one drinking water from the victim’s nameless management outside the 405 Seoul Han River as of Yongsan-gu, Yongsan-gu, Seoul. The Defendant made payment by using the string card that he acquired as of the above paragraph (1) as if the Defendant’s physical card was the Defendant’s physical card, thereby thefting with drinking water equivalent to KRW 1,300, which is the victim’s possession, from that time until May 13:54, 2020.
