A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Punishment of the crime
The defendant of "2016 Highest 6913" is a full-time E representative in Nam-gu Incheon Metropolitan City D, who employs 33 full-time workers and operates the business of manufacturing mobile phone parts.
The direct production process of the manufacturing industry may employ dispatched workers only when there is a vacancy due to childbirth, disease, injury, etc. or when it is necessary to secure human resources temporarily and intermittently.
Nevertheless, from January 28, 2015 to February 23, 2016, the Defendant was dispatched to 103 workers, such as F, inasmuch as there is no need to secure human resources temporarily and intermittently at the above workplace, but the process of manufacturing mobile phone parts was used by the Defendant.
As a result, the Defendant was provided with the labor for the direct production process of the manufacturing industry.
The defendant of "2017 Highest 1618" is the representative of E located in Nam-gu Incheon Metropolitan City D, and is a safety and health management officer who actually controls safety and health affairs for workers in the workplace.
