[2018 Highest 298] On August 21, 2017, the Defendant posted a false letter to the effect that, by using a mobile phone in the Internet Nuridong-dong (hereinafter referred to as Seongdong-gu Seoul Metropolitan Government) and on the bulletin board of the country of the Republic of Korea, the Defendant would deliver a mobile phone to the victim E who reported and contacted, and then deliver the mobile phone to the victim E.

A false statement was made.

However, even if the defendant receives money from the injured party, he did not have the intention or ability to deliver the mobile phone to the injured party.

On the same day, the defendant was transferred 300,000 won to the account under the name of the defendant as the price for goods from the damaged person.

In addition, the Defendant, from that time until November 29, 2017, received a total of KRW 3,055,000 by deceiving the victims 17 times in total by the aforementioned method as shown in the list of crimes in the attached Table (1).

Accordingly, the defendant was informed of the victims to receive property.

[2018 Highest 437] On May 5, 2017, the Defendant posted a false statement to the effect that he/she would send money to the victim F, who reported and contacted, via a portable phone, to the “China and Highest Countries” online site using a portable phone, and to the effect that he/she would send money to the victim F.

However, the defendant did not have intention or ability to sell goods even if he received money from the injured party because he did not possess a portable phone at the time.

The defendant deceivings the victim as above and was transferred KRW 300,000 to the case bank account with the name of the defendant on the same day from the victim.

[2018 Highest 514] On November 16, 2017, the Defendant, using a portable phone at an insular site, connects the Internet site to the “highest country,” and sells the title “Aphone 864 equipment short, 620,000 normal terminated goods.”
