1. Defendant C and D organizations jointly share KRW 5,00,000,000 to Plaintiff A trade union, and their related thereto from April 23, 2013 to September 2015.
1. Basic facts
A. 1) The Plaintiff Union is a teachers’ trade union established for the purpose of improving working conditions and enhancing the social and economic status of school personnel. The Plaintiff B, one of the union members who led the formation of the Plaintiff Union, served as the chairperson of the A UnionF from February 2, 2005 to February 2008, and as the vice chairperson of the A Association from January 1, 201 to December 31, 2012, the Defendant C is the representative of the H organization.
Defendant C and D’s organization conducted demonstration with the content of opposing the Plaintiffs as seen below, and distributed relevant news report data.
On the other hand, as seen below, Defendant E posted some of the above demonstration and news report materials on the Internet free debate room.
B. Facts 1) Defendant C and D conducted a demonstration on March 19, 2013, April 2, 2013, April 9, 2013, April 16, 2013; and on April 16, 2013, Defendant C and D conducted a demonstration using each banner and diskettes before J on March 26, 2013; 2) the demonstration described in the above paragraph 1 in the Plaintiff B’s photograph, stating that “A association used a banner, on the side of the Plaintiff B’s photograph, including “the heart - B, and 180 persons who provided education in the Republic of Korea against students,” and that “A association’s association distributed materials related to the news report 1,000,” and that “A association distributed materials related to the news report 1,000 persons who provided education in the Republic of Korea against students.”
B. (1) Around the time of the demonstration described in paragraph (1), the Plaintiffs distributed news report materials containing the following contents, which were at issue in the instant lawsuit. (2) On March 19, 2013, the education community of news report materials circulation as “A association” is an incompetence of education.
