1. The Defendants shall jointly and severally pay to the Plaintiff KRW 40,000,000 and the interest rate thereon from December 18, 2008 to the date of full payment.

Reasons

1. Indication of Claim: The Defendants assume the same obligation as the order in accordance with the judgment No. 2008da314171 of this Court, and bring an action to prevent the extinction of prescription;

2. Grounds;

(a) As to Defendant 1.: Judgment by public notice (Article 208(3)3 of the Civil Procedure Act);

B. As to Defendant 2.: Judgment on deemed confession (Articles 208(3)2 and 150(3) of the Civil Procedure Act);
