For the reasons indicated in its reasoning, the lower court upheld the first instance judgment that acquitted the Defendant on the charge of fraud among the facts charged in the instant case on the ground that there was no proof of the crime.

In light of the records, the above judgment of the court below is just, and contrary to the allegations in the grounds of appeal, there is no error of misapprehending the legal principles as to the criminal intent by deception in fraud, or by misapprehending the legal principles as to the fact that the court below exceeded the limits of free emulition by violating logical

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
