Punishment of the crime
1. To export goods to a foreign country Defendant A, an export declaration stating the name, standard, quantity, price, origin, etc. of the goods concerned must be submitted to the customs office and shall be accepted;
Nevertheless, the Defendant, after importing and carrying out simple processing and inspection, such as sealing, end processing, and unfolding, and then then importing as raw materials of the Chinese manufacturing plant Dr. Dr. of the Republic of Korea, the Defendant mistakens that the origin may be changed to Korean origin even though simply processing in the Republic of Korea, and filed an export declaration, stating that the name “REPOCESD (re-processing)” in the name column of the Customs declaration, as if Korean origin is Korean origin, could be entered and reported.
From March 5, 2008 to April 10, 2012, the Defendant submitted an export declaration stating the origin of 13,914,500 U.S. dollars 2,69,959 to a customs office and exported it to a Chinese manufacturing factory upon receipt of an export declaration.
2. Defendant B, a representative director of the Defendant, violated the Customs Act regarding the Defendant’s business at the time and place specified in paragraph (1).
